A 2015 MRI study found signs of alar ligament injury in 55% of older patients whose chronic neck pain had no other identifiable cause. For Boston and Massachusetts personal injury attorneys, that finding speaks to a familiar problem: the client who still hurts months after a car crash, but whose standard imaging reads as “normal” or “age-related degeneration.”

The number that should stop every elective-surgery patient in their tracks is 94%. In a large 2017 Journal of Pain Research study of 1,842 people who had undergone lumbar spine surgery, 94% reported some degree of residual low-back pain. That does not mean 94% had severe pain, nor does it mean 94% of the operations were surgical failures. But for an invasive procedure that many patients understandably hope will eliminate their back pain, the persistence of any low-back pain in such a large proportion of respondents is difficult to dismiss. The same study found that 20.6% met the researchers’ criteria for failed back surgery syndrome —roughly one out of every five patients. Residual numbness was reported by 69.8%, cold sensations by 43.3%, and paresthesia such as tingling or abnormal sensations by 35.3%.

The medical literature recognizes restraint-related injuries to the spine and abdominal structures. Rutherford documented the increase in neck sprains and sternum fractures following compulsory seat-belt use and separately identified an apparent, unexpected increase in abdominal-organ injuries. Later medical literature continued to emphasize the significance of the seat-belt sign and its association with internal injury.

When a person is injured in a motor vehicle crash, the physical evidence of what happened can sometimes be found directly on the body. One of the most important examples is the seat belt sign—a visible bruise, abrasion, or patterned injury corresponding to the path of the restraint. For attorneys handling Boston and Massachusetts motor vehicle injury cases, a documented seat-belt mark can be important evidence because it shows that substantial restraint forces were actually transmitted through the occupant’s body.

They evaluated 93 patients with chronic whiplash symptoms and discovered something fascinating. They divided the sample into three groups. The answer depended heavily on what kind of symptoms the patient had. 74% of Chronic Whiplash Patients Improved The patients received an average of 19.3 treatments over approximately 4.1 months. The treatment consisted of chiropractic spinal manipulation using a high-velocity, low-amplitude thrust directed at specific vertebral segments. The big result? 69 of the 93 patients improved following chiropractic treatment.

The results included improvements not only in symptoms, but also in neurological examination findings and MRI measurements. After approximately 2½ weeks and only five treatments, the patient reported that her radicular symptoms had disappeared and she had returned to normal activities of daily living.
For people dealing with a herniated disc, degenerative disc disease, sciatica, or chronic low back pain, ordinary activities can become exhausting. Fortunately, research suggests that non-surgical spinal decompression may offer relief for carefully selected patients—and your spinal discs may appreciate the extra space. A July 2010 study published in BMC Musculoskeletal Disorders examined whether increased lumbar disc height following non-surgical spinal decompression was associated with reduced disc-related low back pain. The results were encouraging, although the researchers emphasized that larger randomized studies are still needed.

A March 2025 study in the Journal of Contemporary Chiropractic examined another conservative option—non-surgical spinal decompression—and the results are encouraging for patients looking to avoid surgery. What Is Non-Surgical Spinal Decompression? Non-surgical spinal decompression is a targeted, computerized treatment that gently stretches the spine using precise, controlled forces. Unlike traditional traction, advanced decompression systems are designed to reduce pressure within damaged spinal discs while minimizing muscle guarding. The goal is to: Reduce pressure on irritated spinal nerves Improve the flow of nutrients and oxygen into damaged discs Encourage the body’s natural healing processes Reduce pain and inflammation Improve spinal mobility and function For many patients suffering from lumbar disc injuries, this treatment offers a conservative alternative before considering injections or surgery.

Key Finding: Long-Term Health Complaints Are More Common The study found that individuals involved in rear-end collisions were more likely to report future health complaints, including: Chronic neck pain Persistent headaches Musculoskeletal discomfort General health issues Importantly, these were not always immediate. Many individuals developed or continued to experience symptoms well after the initial event. For attorneys handling cases in Boston and throughout the Greater Boston Area, this finding necessitates that you account for this fact in your settlement discussions.
In cases throughout Boston and the Greater Boston Area, this scenario is common. Clients report ongoing neck pain, headaches, dizziness, and functional limitations, while the defense relies on unremarkable MRIs to argue “no injury.” Emerging evidence suggests something critical is often overlooked: alar ligament injury. A 2015 study by Chen et al. in the Journal of Central South University of Medical Science examined MRI findings in patients with chronic whiplash and suspected alar ligament injury, particularly in older adults—offering a clearer explanation for persistent symptoms and a pathway to stronger causation arguments.

Insurance companies often use low vehicle damage as a proxy for low bodily injury. But a May 2019 study published in Traffic Injury Prevention suggests that the relationship between vehicle damage and injury is far more complicated. Researchers Kayla Fewster, Robert Parkinson, and Jack Callaghan examined the characteristics of motor vehicle collisions associated with claimed low back pain. Their findings provide important insight into why seemingly minor crashes can still produce legitimate lumbar spine injuries.

Researchers investigated whether people who sustained a low back injury in a motor vehicle collision were more likely to experience future low back pain later in life. Their findings provide compelling evidence that a motor vehicle collision can have long-lasting consequences, even long after the accident itself has faded from memory. For personal injury attorneys, this study provides powerful scientific support for the concept that a collision can permanently alter the health of the lumbar spine.

A landmark systematic review and meta-analysis published by Nolet in Physical Medicine & Rehabiliation in 2019 challenges that assumption. Researchers analyzed the best available scientific evidence to determine whether exposure to a motor vehicle collision increases the risk of developing future neck pain. Their conclusion was clear: individuals involved in motor vehicle collisions are significantly more likely to experience long-term neck pain than people who have never been injured in a crash.

Insurance companies often portray whiplash as a minor injury that resolves in a few weeks with little more than rest and over-the-counter pain medication. Yet anyone who has represented clients following a motor vehicle collision knows the reality can be very different. Persistent neck pain, headaches, dizziness, numbness, and chronic disability frequently continue long after the damaged vehicle has been repaired. A comprehensive review published in Advances in Orthopedics in 2018 explains why whiplash is far more complex than many people realize. The authors describe whiplash as a biomechanical injury capable of damaging multiple tissues throughout the cervical spine, including the facet joints, ligaments, muscles, intervertebral discs, and nerve structures.

“The MRI is normal, so there can’t be a serious injury.” Fortunately, modern science tells a different story. A landmark review by Les Barnsley, Susan Lord, and Nikolai Bogduk, published in Pain, fundamentally changed how physicians understand whiplash-associated disorders. The paper reviewed decades of biomechanical and clinical evidence and concluded that whiplash is a legitimate injury with identifiable anatomical pain generators—even when conventional imaging appears normal.

“There wasn’t enough vehicle damage to cause an injury.” Many attorneys have heard it. Many jurors have believed it. Yet the scientific evidence tells a much different story. Having taken care of these car crash victims for 36 years in my Boston Chiropractic office, I know this to be a fact. A landmark review titled “Deceleration During ‘Real Life’ Motor Vehicle Collisions” examined whether the change in vehicle velocity (commonly called Delta-V or ΔV) can accurately predict cervical spine injury. The authors reached an important conclusion for litigators: Delta-V alone is not a reliable predictor of whether a person will sustain a neck injury.

For decades, few injuries have generated as much controversy in personal injury litigation as whiplash. Defense experts have questioned its legitimacy, insurers have challenged its severity, and juries have often struggled with claims involving persistent symptoms despite normal imaging studies. Yet modern research increasingly supports the conclusion that whiplash-associated disorders (WAD) are legitimate injuries with identifiable biomechanical and neurophysiological mechanisms.

For decades, whiplash injury cases have presented a challenge for personal injury attorneys. Clients often report significant neck pain following a motor vehicle collision, yet conventional imaging studies frequently fail to identify a clear source of the symptoms. Defense experts may argue that the absence of MRI or CT findings suggests a minor injury or no injury at all. Research by Dr. Nikolai Bogduk, widely considered the leading anatomical researcher, helped change that conversation.
